Processing of your data in the context of the legal services provided by us

If you are our client or business partner or make an inquiry with us because you are interested in the legal services we offer, the type, scope and purpose of the processing of your data depends on the contractual or pre-contractual relationship between us. In this sense, the data processed by us includes all those data that are or have been provided by you for the purpose of using the contractual or pre-contractual services and that are needed to process your request or the contract concluded between us. Unless otherwise stated in the further information in this data protection declaration, the processing of your data is limited to those data that is necessary and appropriate to answer your inquiries and/or to fulfil the contract concluded between you and us, to safeguard our rights and to fulfil legal obligations. We will inform you which data is required for this before or as part of the data collection. If it is necessary to fulfil the contract concluded between us, to protect your vital interests or due to legal provisions, we will transfer your data to third parties in compliance with our professional requirements for confidentiality, such as (Justice) authorities, billing centres and tax consultants. Insofar as we use third-party providers to provide our services, the data protection information of the respective third-party providers applies.

Data affected:

  • Inventory data (e.g. Names, addresses)
  • Payment data (e.g. Bank details, invoices)
  • Contact data (e.g. E-mail address, telephone number, postal address)
  • Contract data (e.g. Subject matter of the contract, duration of the contract)
Persons affected: Clients, interested parties, business and contractual partners
Processing purpose: Processing of contractual services, communication and answering contact inquiries, office and organisational procedures
Legal basis: Contract fulfilment and pre-contractual inquiries, Art. 6 para. 1 lit. b GDPR, legal obligation, Art. 6 para. 1 lit. c GDPR, legitimate interest, Art. 6 para. 1 lit. f GDPR
Delete: See the point: "When do we delete your data?" . In addition, we would like to draw your attention to the fact that we are obliged according to § 50 BRAO to keep files for a period of six years.

Your rights under the GDPR

According to the GDPR, you are entitled to the following rights, which you can assert at any time from the person responsible mentioned in section 1. of this data protection declaration:

  • Right to information: You have the right to request information from us about whether and what data we process from you.
  • Right to rectification: You have the right to request the correction of incorrect or incomplete data to be completed.
  • Right to deletion: You have the right to request the deletion of your data.
  • Right to restriction: In certain cases, you have the right to request that we process your data only to a limited extent.
  • Right to data portability: You have the right to request that we transmit your data to you or another person responsible in a structured, common and machine-readable format.
  • Right of complaint: You have the right to complain to a supervisory authority. The supervisory authority of your usual place of residence, your workplace or our company headquarters is responsible.

Right of withdrawal

You have the right to revoke your consent to data processing at any time.

Right of objection

You have the right to object at any time to the processing of your data, which we base on our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR. If you make use of your right to object, we ask you to explain the reasons. We will then no longer process your personal data unless we can prove to you that compelling legitimate reasons for data processing outweigh your interests and rights.

Regardless of the above, you have the right at any time to object to the processing of your personal data for purposes of advertising and data analysis.

Please address your objection to the contact address of the person responsible given above.

When will we delete your data?

We delete your data when we no longer need it or you specify this to us. This means that - unless otherwise stated in the individual data protection information of this data protection declaration - we delete your data,

  • if the purpose of the data processing has disappeared and thus the respective legal basis mentioned in the individual data protection notices no longer exists, e.g.

  • after termination of the existing contractual or membership relationships between us (Art. 6 para. 1 lit. a GDPR) or

  • after the lase of our legitimate interest in the further processing or storage of your data (Art. 6 para. 1 lit. f DSGVO),

  • if you make use of your right of withdrawal and no other legal basis for the processing within the meaning of Art. 6 para. 1 lit. b-f GDPR intervenes,

  • if you make use of your right to object and the deletion does not preclude compelling reasons worthy of protection.

However, if we (certain parts) still have to keep your data for other purposes, because these are, for example, tax retention periods (usually 6 years for business correspondence or 10 years for accounting documents) or the assertion, exercise or Defence of legal claims arising from contractual relationships (up to four years) or the data is used to protect the rights of another natural or legal person, we delete (the part) of your data only after expiry of these periods. Until the expiry of these periods, however, we limit the processing of this data to these purposes (fulfilment of retention obligations).

Our website uses cookies. Cookies are small text files consisting of a series of numbers and letters that are stored and stored on the terminal device you are using. Cookies are primarily used to exchange information between the device you use and our website. This includes, among other things, the language settings on a website, the login status or the place where a video was watched.

Two types of cookies are used when visiting our websites:

Viewing certain content, using functions, etc.) can be stored in a user profile. Such profiles are used to show users content that corresponds to their potential interests. Insofar as we use services through which cookies are stored on your device for statistical, marketing and personalisation purposes, we will inform you separately in the following sections of our privacy policy or as part of obtaining your consent.

Persons affected: Users of our online offers

Processing purpose: Playing our Internet pages, ensuring the operation of our Internet pages, improving our Internet offer, communication and marketing

Legal basis: Legitimate interest, Art. 6 para. 1 lit. f GDPR

Unless we obtain your consent to the setting of cookies, we base the processing of your data on our legitimate interest in improving the quality and useability of our website, in particular the content and functions. You have to object to the use of cookies set by us as part of our legitimate interest via the security settings of your browser. There you have the option of determining whether you do not accept cookies from the outset or only on request or whether you want cookies to be deleted after each time you close your browser. If cookies are deactivated for our website, it may no longer be possible to fully use all functions of the website.

Consent, Art. 6 para. 1 lit. a GDPR

If we ask you to be allowed to place certain cookies on your device before you visit our website and you consent to this, the legal basis must be seen in the consent you have given. As part of the consent, we will inform you about which cookies we set in detail. If you do not give this consent, only the so-called technically necessary cookies are set, which are necessary for the proper operation of our websites and their presentation in your browser. If you have consented to the setting of cookies, you have the possibility at any time to revoke the consent given to us.
